Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. Following his repatriation to the United States to face human smuggling charges, he was held in federal custody.
In her decision, the judge noted that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
